Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hexly (the "Service"), a browser extension and associated website operated by Kevin Kwok, an individual based in Indonesia, operating under the name "Hexly" ("we," "us," "our"). By installing, accessing, or using Hexly, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Hexly is a Chrome extension that extracts color palettes, fonts, and CSS information from web pages a user chooses to visit, and displays this information back to the user within the extension. All extraction and processing happens locally in the user's browser. Hexly does not transmit page content, URLs, or extracted design data to our servers.

2. Accounts and Plans

Hexly is available in the following tiers:

  • Guest — limited free usage with no account required.
  • Free account — requires sign-in (via Google), with a daily usage allowance.
  • Pro — a paid subscription, billed monthly or annually, that removes the daily usage allowance.

A "run" is counted each time you activate the Hexly extension on a page. Usage limits, where applicable, are enforced and tracked on our servers, not within the extension itself.

Every feature in Hexly is available on every tier, including Guest, at all times. The only difference between tiers is the number of runs allowed per day. We do not restrict features to paid plans, and any new feature we add in the future will be available across all tiers as well.

We may change the features, limits, or structure of these tiers at any time. We'll make reasonable efforts to notify users of material changes that affect a paid subscription.

3. Payment and Billing

Paid subscriptions are billed and processed by Paddle.com Market Limited ("Paddle"), our payment provider and merchant of record. Paddle handles billing, currency conversion, tax collection, and payment security on our behalf. Your relationship with Paddle regarding payment processing is governed by Paddle's own terms, available at paddle.com.

Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on your plan) unless cancelled beforehand. You may cancel at any time through your account; upon cancellation, you retain access to Pro features until the end of your current paid period, after which your account reverts to the Free tier.

4. Refunds

Our refund policy is set out separately in our Refund Policy, which forms part of these Terms.

5. Acceptable Use

You agree not to:

  • Use Hexly to violate any applicable law or third party's rights, including intellectual property or privacy rights;
  • Attempt to circumvent usage limits, security measures, or authentication systems;
  • Reverse-engineer, decompile, or resell the Service without our written permission;
  • Use automated means to abuse, scrape, or overload our backend services.

We may suspend or terminate access for accounts that violate these Terms.

6. Intellectual Property

Hexly, its branding, and its underlying code are owned by us. Using the Service does not grant you any ownership over Hexly itself. Color, font, and style data extracted from a website belongs to that website's owner — Hexly is a tool for inspecting publicly rendered styles, and using extracted data remains your responsibility under applicable copyright and trademark law.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that extraction results will be perfectly accurate, that the Service will be uninterrupted, or that it will work on every website (some pages, including those with restrictive security policies, may not be readable by design).

8. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles, except where applicable consumer protection law in your country of residence grants you additional non-waivable rights, in which case those rights apply.
